These Terms & Conditions govern how academies, coaches, players, and authorized users access and use Chess Insight, including game synchronization from Chess.com and Lichess, AI-assisted analysis, dashboards, reports, subscription features, and related services.
1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your access to and use of the Chess Insight platform available at chessinsight.in and any related websites, applications, products, and services (collectively, the "Service"), operated by Chess Insight ("Chess Insight," "we," "us," or "our").
By creating an account, starting a trial, purchasing a subscription, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not access or use the Service.
2. Eligibility
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to register as an academy administrator, coach, or organizational representative.
If you create or manage an account on behalf of an academy, coaching organization, educational institution, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.
Players and students may be added to academy rosters by authorized coaches or administrators. Academies and coaches are solely responsible for obtaining any parental consent, guardian consent, authorization, or permissions required under applicable laws before adding minors or sharing player information through the Service.
3. Account Registration and Security
You are responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account.
You agree to:
- Provide accurate, current, and complete registration information.
- Keep your account information updated.
- Take reasonable measures to prevent unauthorized access to your account.
- Notify us promptly at support@chessinsight.in if you become aware of any unauthorized access, security breach, or misuse of your account.
We reserve the right to suspend, restrict, or terminate accounts that contain inaccurate information, violate these Terms, or present legal, operational, or security risks.
4. Academy and Coach Responsibilities
If you use the Service as an academy, coach, trainer, or organizational administrator, you are responsible for:
- Managing academy rosters and assigning appropriate permissions and access levels.
- Ensuring that linked Chess.com and Lichess accounts belong to players you represent or for whom you have obtained proper authorization.
- Using reports, analysis, evaluations, and AI-generated insights as supplementary coaching tools and not as the sole basis for player selection, ranking, qualification, disciplinary action, or eligibility decisions.
- Maintaining compliance with applicable education, child protection, privacy, and data protection laws.
- Ensuring that player information submitted to the Service is accurate and lawfully obtained.
5. User Data and Accuracy
You are responsible for the accuracy, legality, completeness, and authorization of all information, player records, usernames, account links, and other content submitted to the Service.
Chess Insight is not responsible for errors, inaccuracies, incomplete analysis, or reporting issues resulting from incorrect player information, incorrectly linked Chess.com or Lichess accounts, outdated records, unauthorized submissions, or inaccurate data provided by users.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, deceptive, or abusive purpose.
- Interfere with, disrupt, overload, or compromise the security, integrity, or availability of the Service.
- Attempt to reverse engineer, decompile, disassemble, copy, scrape, or extract proprietary components of the Service except where expressly permitted by law.
- Upload malware, malicious software, viruses, or harmful code.
- Attempt unauthorized access to accounts, systems, networks, or data belonging to other users.
- Misrepresent your identity, affiliation, authority, or relationship with Chess Insight.
- Infringe the intellectual property, privacy, publicity, or other legal rights of any person or entity.
- Resell, sublicense, redistribute, or provide unauthorized access to the Service except as expressly permitted under your subscription plan.
We reserve the right to investigate suspected violations of these Terms and take any action we consider appropriate, including content removal, account suspension, account termination, or legal action.
7. Intellectual Property
The Service, including its software, analytics systems, dashboards, databases, documentation, branding, logos, visual elements, designs, and underlying technology, is owned by Chess Insight or its licensors and is protected by applicable intellectual property laws.
Except for the limited rights expressly granted under these Terms, no rights, title, or interest in the Service are transferred to you.
You retain ownership of academy data, player information, roster information, and game-related content that you import, synchronize, or submit to the Service.
You grant Chess Insight a limited, non-exclusive, worldwide, royalty-free license to host, process, analyze, store, and display such content solely for the purpose of operating, maintaining, securing, supporting, and improving the Service.
Chess.com, Lichess, FIDE, and other third-party names, trademarks, logos, and service marks remain the property of their respective owners. Chess Insight is not affiliated with, endorsed by, sponsored by, or officially associated with Chess.com, Lichess, FIDE, or any other third-party organization unless expressly stated otherwise.
8. Third-Party Services
Certain features of the Service depend upon third-party platforms, infrastructure providers, payment processors, cloud services, and external data sources, including Chess.com and Lichess.
The availability, functionality, accuracy, and policies of such third-party services are outside our control. We are not responsible for interruptions, delays, inaccuracies, limitations, service outages, API restrictions, or policy changes caused by third-party providers.
Your use of third-party services may also be subject to the terms and privacy policies of those providers.
9. Subscriptions and Payments
Certain features of the Service are available only through paid subscription plans.
By purchasing a subscription, you authorize Chess Insight and its payment providers to charge the applicable subscription fees, taxes, and related charges using your selected payment method.
Billing Cycles
Subscriptions renew automatically at the end of each billing cycle (monthly, annual, or otherwise specified) unless cancelled before the renewal date.
Failed Payments
If payment cannot be successfully processed, we may:
- Retry the charge.
- Restrict access to premium features.
- Suspend or terminate the affected account after reasonable notice.
Plan Changes
Subscription upgrades may take effect immediately and may result in prorated charges where applicable.
Subscription downgrades generally take effect at the beginning of the next billing cycle unless otherwise stated.
Pricing and Features
We reserve the right to modify subscription pricing, plan limits, features, quotas, or service offerings. Material changes affecting active subscriptions will be communicated with reasonable advance notice.
10. Refund Policy
Except where required by applicable law, subscription fees are non-refundable once a billing period has commenced.
If you cancel a subscription, you will continue to have access to paid features until the end of the current subscription term.
If you believe you have been charged in error, you must contact support@chessinsight.in within fourteen (14) days of the charge date. We will review good-faith billing disputes and may issue refunds, credits, or adjustments at our discretion.
11. Service Availability
We strive to provide a reliable and continuously improving Service; however, uninterrupted availability cannot be guaranteed.
The Service is provided on an "as available" basis. Interruptions may occur due to:
- Scheduled maintenance.
- Software updates and deployments.
- Third-party service outages.
- Network disruptions.
- Security incidents.
- Events beyond our reasonable control.
We may modify, improve, replace, suspend, or discontinue features or functionality from time to time. Where reasonably practicable, we will provide advance notice of material changes.
Beta, preview, experimental, or early-access features may be modified or withdrawn at any time.
12. AI-Generated Analysis and Recommendations
The Service includes automated analysis, chess engine evaluations, AI-generated summaries, recommendations, reports, and performance insights.
Such outputs are generated using automated systems and may be inaccurate, incomplete, outdated, inconsistent, or unsuitable for particular circumstances.
Users remain solely responsible for decisions made using analysis, evaluations, reports, recommendations, or AI-generated content provided through the Service.
Chess Insight does not guarantee the accuracy, reliability, completeness, or suitability of any AI-generated content.
13. Data Retention and Deletion
Upon account closure or termination, we may retain certain information where necessary for legal compliance, security, fraud prevention, dispute resolution, auditing, accounting, backup, or operational purposes.
Academy, player, and account data may be deleted following a reasonable retention period in accordance with our Privacy Policy and applicable legal requirements.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
CHESS INSIGHT DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED OPERATION.
WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, AVAILABLE AT ALL TIMES, OR FREE FROM HARMFUL COMPONENTS.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHESS INSIGHT, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR BUSINESS INTERRUPTION.
OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF:
- THE TOTAL AMOUNT PAID BY YOU TO CHESS INSIGHT DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
- INR 10,000.
Where applicable law does not permit certain limitations, liability shall be limited to the maximum extent permitted by law.
16. Indemnification
You agree to defend, indemnify, and hold harmless Chess Insight and its owners, officers, employees, contractors, affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, expenses, and reasonable legal fees arising out of or related to: your use of the Service; your violation of these Terms; content, information, or data submitted through your account; your academy roster, player records, or imported data; your violation of applicable laws or regulations; your infringement of any intellectual property, privacy, publicity, or other rights of a third party; or the addition of player data without appropriate authorization or consent.
17. Force Majeure
Chess Insight shall not be liable for any delay, interruption, or failure to perform resulting from causes beyond its reasonable control, including natural disasters, pandemics, cyberattacks, internet outages, governmental actions, labor disputes, utility failures, infrastructure failures, or failures of third-party service providers.
18. Suspension and Termination
You may cancel your subscription or close your account at any time through available account settings or by contacting us.
We may suspend, restrict, or terminate access to the Service if:
- You violate these Terms.
- Payment obligations are not fulfilled.
- We reasonably believe continued access presents legal, operational, reputational, or security risks.
- We are required to do so by law or regulatory authority.
Upon termination, your right to access and use the Service immediately ceases.
Any provisions that by their nature should survive termination, including payment obligations, intellectual property rights, disclaimers, limitations of liability, indemnification obligations, and dispute-related provisions, shall remain in effect.
19. Changes to These Terms
We may update these Terms from time to time to reflect changes in the Service, legal requirements, or business operations.
Updated versions will be published on this page together with the revised "Last updated" date.
For material changes, we may also provide notice through email, in-product notifications, or other reasonable communication methods.
Your continued use of the Service after revised Terms become effective constitutes acceptance of the updated Terms.
20. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Coimbatore, Tamil Nadu, India.
Before initiating formal legal proceedings, you agree to first contact Chess Insight at support@chessinsight.in and make a good-faith effort to resolve the matter informally.
